Is it legal for school officials to read the text messages of students who have their cell phones confiscated? Or does this violate their right to privacy?

Yes that is a violation of our rights. There is no right for a school official to read a students text messages. How would they like it if we went in and read their emails? I would think they wouldt be to happy just like we wouldnt be happy if they read our texts. Texts are something private, and its none of their business.
i agree. but i do think that there should be a basket or something students should have to put their phones in before class starts just so it's not a problem during class. you don't have to text your bff jill every 2 seconds during class.
Teachers can take the phone away but they can't read the messages. Even though you're not supposed to bring them at school you can use them between classes so in a way school doesn't have a clear policy on it.
Yes.. that would be like us going on a teachers computer and reading all your information.. would that be invasion of your privacy.. i dont think phones are really that big of a deal.. half the time i talk to my mom.. and i agree with ren.. have a basket or something
Yes, that would probably violate the rights of the student. The teacher should probably be able to confiscate phones, but not read what is inside of them.
I agree its alrite for them to take them but not get into are personal life cause we dont go through there stuff
I believe it is a great violation of privacy because the phone is the student's private property and even though it is in the school the phone is owned by the student and any teacher who views messages on someones phone should be found guilty of invasion of privacy

yes it is a violation of our right to privacy. the can take them away but not read or even open your phone if they take your phone away.
Yes that is a violation of our privacy to read our text messages even though they have the right to confiscate our phones they have no right to go through our personal stuff.
No i dont think its right, just because its of our own privacy and if the teacher finds the phone, the only consequence should be getting it taken away.

Yes, it is a violation of individual rights for school officials to read text messages on confiscated cell phones. It is not a violation to confiscate cell phones if they are being used inappropriately at school and returned in a timely manner. There is a time and place for text messaging and responsible use dictates that school time is not on the cell phone fair use plan.
I agree with the general consensus that they have the right to take the phone away, but not to read the text. The teachers already know what the student is doing-he or she is having a personal conversation (at the wrong time, of course). There is no reason that they should read the text.
As I suspect you are quite familiar Mr. Witman, the Supreme Court feels that students are not afforded the same privileges as others. Public school officials are allowed to "search and seize" when having "reasonable suspicion", without due process or a warrant. So reading text messages on a students phone would fall with in that realm. Further more Private schools, are allowed to define whatever criteria the decide, in essence meaning that there are NO implied rights for students.
You can take our phones away but techers have no right to go through our text messages. Its our business not theres. They wouldnt like us to go through there computer.
I agree with Dylan in the fact that it is the students private property. However if the student just left it turned off or in a basket like Ren stated then there would be no problem with students having to worry about the teachers reading their texts.
I believe that this is a question that has been around for quite some time. There is almost no difference in a teacher reading texts on a confiscated cell phone than a teacher confiscating a written note circulating the room on a piece of loose leaf notebook paper. Was it legal for the teachers to read those notes aloud to the class then? Who knows, but they did it anyways. I do not think it is right to read students' texts on confiscated cell phones but I'm still not sure of the legality of the matter.
i think that is is not right. that is a violation of privacy. even though we don't have a RIGHT to privacy that is wrong!!
Yes this is a very big violation of our rights. If you read my text messages can i read your quick mail? I don't care what you say you have no right in reading them. My mom and dad trust me enough not to read them, so why should you get to read them.
I think that when they take our phones away in class that is embarrassing enough, but if they snoop through them that is worse. and they should not be able to do that, they should have the student turn it off before they hand it to the teacher and then you can turn it on when you get it back

yea its not there right to red texts or things like that. They can take away cell phones but in my opinion anything on it is private property.
if the student gets caught and doesn't have a lock on their texting, then it's fine if the teacher reads it, for safety reasons.
A teacher has a right to confiscate a phone if it is disrupting class but he/she does not have the right to read what is on the phone. This is private property of the student.

Although I don't think it's right, I think the school is able to do that without any legal trouble. Look at gtowncowboy's post. So it all boils down to what the teacher considers "suspicious" or whatever it takes to make them have probable cause.
I think just by common courtesy though, the teacher wouldn't do it. But who knows, maybe one of these days you'll run into an intruding jerk of a teacher.
I think it violates our privacy rights. Teachers should be aloud to take our phone if we are messing around on it, but they have no right reading through are messages or going through pictures ect. Thats why I have a lock on mine for that reason and other kids trying to read them.

I think this is invasion of privacy. We can't read their emails so why should they read our messages... plus some of the times, our messages are from when we are home. If they take it away, they need to put it away. It is none of their business what that text message says....
I think that it is a violation of our rights for a teacher to read a students text messages. The messages are private and I don't like the idea that a teacher can read about whats going on in our personal lives.

It is a violation of our privacy because if the text messages that they were reading were ones that we had gotten outside school our then they have no right to read them. I think they can read them if they have probable cause.

i agree they should have something for you to put your cell phone in. It's only ur business what you say on text and should be kept to yourself.
this definitely does violate students' privacy rights. it is none of the teachers business what the students are texting; it could be very personal. Although I do think that if a student is using it in class the teachers have the right to take it away until class is up, the teachers should definitely not be allowed to read the messages.
I agree with Eryn. When the school officials begin to break a privacy that is the begin signs of Communism yes its over a cell phone but what will they stop at next it will be legal to strip search the fellow student body. As are country begins to slowly lose are rights in the 1st amendment are country is going to be open for others to take us over.
